TERMS AND CONDITIONS.
By submitting this Registration Form to The Byron Business Group, you acknowledge that you have read, accepted and understood the Terms and Conditions set out as follows. Please sign the bottom of this page to acknowledge that you have read, understood and accepted all these terms and conditions. Any registration form returned without a signature on the bottom of this page will be rejected.
- To be eligible to win the first prize in this competition you must register with The Byron Business Group.
- Judging will be conducted on a daily basis from Monday 2nd April – Wednesday 4th April with the final being held on Thursday 5th April with the selected busker being invited to participate in the Byron Blues & Roots Music Festival.
- Each act will be judged by a panel of judges. The judges decision will be final and no correspondence will be entered into in any regard.
- The winner of the Blues Over Byron Busking Competition will be announced at the end of the final or by 6pm on Thursday 5th April 2007.
- The busker selected to perform at the festival must be available to perform at their designated time and if they cannot do so, they will forfeit their position as winners at the organizers discretion.
- Any groups entering this competition will be limited to 5 members. When a group enters the competition all members must remain the same for the entirety of the competition (including the Blues Festival gig) or the group may be disqualified at the organizers discretion.
- Buskers will be responsible for starting and finishing on time and staying within their designated area whilst performing. Any busker not at their designated venue or area at the commencement of their judging time will forfeit their place in the competition including entry fee.
- Sound levels for street performances are not to exceed background noise by more than 5dBA. Non compliance will result in immediate removal from the competition. Failure to comply will also result in the competitor not being protected by Public Liability Insurance.
- You will provide your own equipment. Entrants performing in heats in ‘Best Original Musician’ will be given access to 1 power supply and an area undercover if the weather is bad.
- If any equipment is provided for the use of any busker or buskers at the competition heats, final or the Blues Festival, the busker or buskers shall be solely responsible for the care and correct use thereof and any damage shall be compensable to the respective owners.
- Authorized officers of the Byron Shire Council or of the NSW Police Service may at any time request a busker to cease busking if the officer is of the opinion that the performance is causing a public inconvenience or is likely to cause harm to the public or property. The busker must immediately comply with such a request. Non-compliance may result in Council officers disconnecting your power supply & immediate removal from the competition.
- Buskers must not use dangerous implements or materials as part of a performance. No flames, pyrotechnics or weapons to be used in a performance. You will not be protected under our public liability insurance if you use anything in a performance that might be dangerous.
- Any leads, fittings and associated objects forming part of the power supply shall be positioned so as not to create a nuisance or danger to the health or well being of the public or other persons. Generally, all leads shall not be allowed to cross the road or footpath unless suitably elevated, such as being attached to the underside of an awning. All electrical cables are to be OH&S compliant and are to be tagged as approved by Workcover.
- You undertake to ensure that the performance and associated fixtures shall be positioned to allow suitable access for pedestrians at all times. You will not be protected under our public liability insurance if you fail to comply.
- You undertake to ensure that the activity shall be carried out so as not to endanger or do anything which is likely to endanger the public. You will not be protected under our public liability insurance if you fail to comply.
- The winner of the competition must be reasonably available for publicity photos and to talk with the press.
- Any Breach of these terms and conditions shall render the party in breach ineligible for any prize in the competition and may also result in the party being asked to cease performing.
- The Byron Shire Council, the Byron Business Group, the Lions Club, Byron United and the East Coast Blues Festival will not accept any responsibility for loss or damage or injury of any kind whatsoever occurring to a participant in this competition and all participants by signing these Terms and Conditions hereby acknowledge they have entered into this competition at their own risk entirely.
- You may be filmed during your performances. The copyright and proprietary rights in all footage is owned, for the life of the copyright by the Byron Business Group. Any such footage may be used or exploited by the Byron Business Group without compensation to you, or permission from you. This includes promotions or commercial exploitation without limitation. You hereby waive all moral rights.
- The Byron Business Group has taken limited public liability insurance to protect third parties from any loss, cost, damage or injury arising from your performance. Should you engage in any activity, before, during or after your performance that renders our insurances void or invalid, you hereby indemnify the Byron Business Group, the Lions Club, Byron United and the East Coast Blues Festival from all losses, costs and damages sustained as a result of your activity.
- This competition is open to all Australian residents or working visa’s
- To win Best Original Musician you must have original content in your music
- Cost to enter Best Original Musician is $20 solo or $30group. Cost to enter Best Street Performer is $15
- Entry forms should be received by Monday 26th March 2007
- Any entrant choosing not to compete must inform & confirm with organizer by Friday 23rd March 2007 or entry fee will be forfeited
